By booking a package provided by Photochitect, you are in agreement with the terms and conditions set out below. Photochitect reserves the right to change these terms and conditions at any time without prior notice.
Booking, Payment & Pricing
After customer paid and agrees with Photochitects’ package, package price are final (not eligible for discount). However, customer are still able to add items if necessary.
- For customer with the package of two events (and above) but decided to proceed with one event first, the payment to be made before the first event is based on the total for one event package (not based on the percentage).
- Deposit required for a booking is RM200 (subject to change). 95% remaining balance are to be paid 2 months before the first event date & the 5% balance are to be paid upon album/product collection. Please note that in the circumstances of any situation, there will be no reimbursement or refund.
- Abandonment or refuse to make payment as agreed upon in the contract, Photochitect reserve the right not to proceed with the services and to make a proceeding in accordance to the law without any prior notice, and all cost will be borne by the client.
- The package price does not include transportation/accommodation charge (if any).
- Transportation & accommodation charges will be implemented on top of the agreed package & to be advised by Photochitect salesperson. For accommodation, a minimum charge of RM130/night will be charged (subject to changes depending on location, currency & package). For transportation, the charge will vary based on event's location.
- Both transportation & accommodation charges are to be agreed prior to booking and no dispute will be entertained upon agreement.
- Photographer & videographer reserve the right not to use the accommodation provided by the customer. Regardless, the customer is required to either arrange accommodation or opt to be charged in the invoice accordingly.
- Price for total package does not include special requests (i.e., courier charges & delivery fee). Customer can collect their products from Photochitect main office (located in Kajang/Ampang) during operating hours without any extra cost. If customer prefer delivery, courier fees will apply.
- If the customer needs the photographer/videographer to attend their rehearsal, additional RM450/shooter & event will be charged per session.
- If the rehearsal, make-up/preparation and event location requires additional fees such as parking fee & entrance fee, Photochitect will charge the customer accordingly with a receipt provided as proof.
- Free items (i.e., outdoor session, posterframe) are not included in the package price. Free items are not usable for discount and are not transferable to cash or other items.
- Free outdoor (portraiture) photoshoot session must be held right after the event ends or just before the event starts, and must be within coverage hours. In case outdoor (portraiture) session are not available due to weather condition, photoshoot are to be held indoor.
- Photochitect are not to be held responsible for any missed shots in situations where customer refuse photoshoot session due to physical condition (i.e., not fit, tired).
- Free outdoor (portraiture) photoshoot session are not allowed to be done on another day, unless customer add-on another photography session for different day outdoor photoshoot. Price will be advised by Photochitect salesperson.
- Distance from make-up/preparation location to event location are 10 kilometers maximum & distance from event location to outdoor location are 10 kilometers maximum. If this radius is exceeded, an additional transportation charge will be incurred by the customer, which will be advised by Photochitect salesperson.
Posting & Marketing
- Photochitect retained the right to use any of the photo(s) and/or video(s) for publicity purpose and advertisements either offline or online, and generally promote the business in advertisements, website, article, magazine and other related form of publications.
Cancellation & Rescheduling
- Deposits are non-refundable if customer cancel the event, as we allow customer to postpone their event within a 24 months period.
- Deposit will be kept by Photochitect if event is postponed.
- Any changes to the event date must be informed at least 30 days in prior, to account for Photochitect availability.
- If a customer wants to downgrade their package, the previously booked package will be canceled, and the customer must adhere to the latest Photochitect package.
Responsibility, liability & Accidents
- In case of accident/injury, natural disaster, violence or death to Photochitect photographer/videographer & anything that are beyond Photochitect’ control during traveling to the event location, Photochitect will find a replacement. If there is no replacement available, Photochitect will refund payment that was made by the customer.
- Photochitect are not responsible for any photographer/videographer lateness due to incomplete address, wrong information or last minute changes which caused photographer/videographer unable to locate the event location.
- Photochitect shall not be held responsible for any accidents, incidents, including causes of death, directly or indirectly related to the customer, that may occur during the event or while traveling to the event/outdoor location.
- Photochitect shall not be held responsible if photographer/videographer fail to capture shots during the event if customer does not provide information regarding details and whom must be included in the photoshoot.
- Softcopy links provided in cloud storage (online) is only valid for 14 days from shared date. If the customer fails to download for their personal backup and requests Photochitect to provide another link, an additional charge will be incurred for management and storage fees.
- If something happens beyond Photochitect control (i.e., lost memory card, stolen, camera failure, storage system & backup system failure or stolen), Photochitect will refund the payment that was made by the customer.
- Photochitect retains the authority to remove any files pertaining to the customer's product (including photos and videos) after a duration of 12 months from the date of the last event.
- As creativity is subjective and opinion based, there will be no refund or compensation if the customer argue on outputs delivered did not meet their expectation - as long as the total quantity product in the package are sufficientand able to be delivered. However, Photochitect will proceed with refund if insufficient product quantity are delivered due to specific reason (i.e., unable to deliver album due to corrupted memory card). Refund amount are subject to the division of the product affected (photo only, video only or both) from the package.
- Refund requests will be processed within 31 working days.
Final Product
- All photos produced by photographers will be returned in softcopy (all photos are not edited except for the photos selected and used in album). Photos given might include mixed result of properly & improperly shot - underexpose, overexpose, cropping, blurry and repeated.
- It is understood by all parties involved with the contract that SOFT COPIES OF EDITED PHOTOS of the event coverage would be delivered within 14-21 business days after events have commenced.
- Album: presentation, layout and photo qualities are as per sample shown.
- Photo: Style, color tones and photography concept are as per sample shown.
- Photochitect can decline requests for editing style, tone, or presets that don't match our established processes and identity, as shown in Photochitect official Instagram and/or by Photochitect salesperson. Consequently, we cannot accommodate requests referring to other companies or photographers.
- By using the services of Photochitect, you agree that only photos captured by Photochitect will be included in the final product. Any requests to incorporate external photos will not be entertained.
- We do not offer major digital manipulation (i.e., inserting background, removing object etc) for images. We do however make minor editing; color and tone adjustment, brightness enhancement and cropping if needed.
- Photochitect allows the customer to make amendments to the album layout only once before printing. Any subsequent amendments will incur a charge of RM50 per page.
- There are no charges for the first-time amendment of customer's album layout that are made during office hours at Photochitect office.A charge of RM50/hour applies for amendments outside Photochitect office, within a 30-kilometer radius.
- Customer are required to leave their comments for amendment in the whatsapp based on the layout given.
- Customers must provide layout feedback within 7 days of receiving it. Late feedbacks won't incur penalties, but delays may affect the delivery timeframe. Photochitect cannot be held responsible for any delivery delays caused by customer lateness.
- For requests of split products (i.e., changing a combined album of solemnization & reception into separate albums for each event) the delivery period will be reset to 60 days from the date of the request, subject to customer's amendments and approval.
- Customers must collect the final product within 30 days after being notified by Photochitect. After this period, Photochitect is not responsible if the product goes missing from Photochitect archive.
- Customer must bare the production cost if final product are damaged or missing after exceeding 30 days.
- Edited (selected photos used in the album) and unedited photos will be stored on the thumbdrive. Each thumbdrive will have a minimum size of 16GB and the total number of thumbdrives provided is determined by the booked package. If additional pendrives are needed, customer are to inform the admin of the group, and a certain price will be charged accordingly.
